We have the honour to address you in our capacities as Special Rapporteur on the situation of human rights defenders and Special Rapporteur on the independence of judges and lawyers, pursuant to Human Rights Council resolutions 34/5 and 35/11.
In this connection, we would like to bring to the attention of your Excellency’s Government information we have received concerningthe amendments to the Law on the Legal Status of Judges and the Law on Public Prosecutor’s Office, which introduce a new procedure for the dismissal of judgesand heads of the prosecution service on the basis of a recommendation from the National Security Council of Mongolia.
We would also like to raise some general concerns with regard to the current procedures for theappointment and dismissal of judges, prosecutors, members of the Judicial General Counciland its Ethics Committees, which appear to be at odds with international standards relating to the independence of the judiciary, the autonomy of the prosecution service and the separation of powers.
